BRA concerned about 5G rollout plans

On 25 July the BRA distributed information regarding a gazette published by the Minister of Communications and Digital Technologies with a new policy on the deployment of communications networks, and encouraged Buccleuch residents to comment.

The policy aims to accommodate the accelerated deployment of electronic communications networks, such as LTE and 5G networks.

  • The policy gives mobile networks and other licensees the RIGHT to select, enter, and use public or private land for the deployment of their network infrastructure.
  • The infrastructure will belong to the network.
  • The property owners is liable for any damage to the facilities
  • You may not charge companies for building on your property, except under certain conditions.

The Kelvin Residents Association has prepared a comprehensive submission to the gazette and we support their view that some of the policy provisions adversely affect private landowners, potentially transgressing on certain important and constitutional rights.

We have recommended some changes to the initial KRA draft submission (in particular to avoid any perception that we endorse 5G conspriracy theories and the addition of a request that international health guidelines be adhered to when the published). The KRA is also working on integrating recommendation received from other bodies and legal advisors.

Given the short timeframe within which we have to submit the comments, we regret that we may not be able to make any further changes to the submission.
